Terms of Service

Welcome to WeRide Today, a mobile application designed to make biking in the city safe, fun, and joyful. WeRide Today is operated by Tumba Solutions Ltd. ("we," "us," or "our"). This Terms of Service Agreement governs your use of the WeRide Today mobile application for iOS and Android.

By accessing or using the app, you agree to be bound by this Agreement. If you do not agree with these terms, please do not use the app.

Privacy and Data Protection

Your privacy is important to us. To understand how we collect, use, and protect your personal information, review our Privacy Policy, which is incorporated into this Agreement by reference. We comply with GDPR, CCPA, HIPAA, and other applicable data protection laws.

Children's Privacy

The app is not intended for children under 13, or the age of digital consent in your country if different. We do not knowingly collect personal information from children under 13. If you are under 13, you may not use the app or provide personal information.

If we learn that we inadvertently collected personal information from a child under 13, we will promptly delete it. If you believe this has happened, contact us at weride AT tumba DOT solutions.

User Accounts

Some features may require an account containing your nickname, avatar, country, sex, and weight. If you request access, editing, or deletion of personal information, or contact us about privacy concerns, we may require identity verification before responding. You are responsible for account credentials and all activity under your account.

Location Data

By using the app, you agree that we may occasionally access location data to provide relevant information. When you enable ride mode, the app regularly records latitude and longitude. This is explicit behavior triggered by the user, and you can manage location sharing in app settings.

The app allows you to connect your account with third-party services such as Strava. By connecting to a third-party service, you grant us permission to access, store, and use information from that service, including nickname, avatar, API token, country, sex, and weight.

Our Service also uses third-party services for certain features. By using the Service, you agree to be bound by the terms and conditions of those services:

• Map services provided by Mapbox.
• Weather services provided by OpenWeatherMap.
• Backend services provided by Firebase: Terms of Service and Privacy and Security.
• File storage services provided by Google Cloud.
• App crash reporting provided by Crashlytics.
• Route planning services provided by OpenRouteService.
• Usage capture by Mixpanel.
• Transactional and marketing email delivery by SendGrid.

We do not control third-party policies and practices, and we encourage you to review their privacy policies before sharing information with them.

Intellectual Property

All content and materials within the app, including text, graphics, logos, icons, images, and software, are the property of Tumba Solutions Ltd. or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the app without written permission.

License and Restrictions

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the app on your mobile device for personal, non-commercial use. You agree not to:

• Reverse engineer, decompile, or disassemble the app.
• Remove copyright, trademark, or proprietary notices from the app.
• Rent, lease, loan, sublicense, distribute, or transfer the app to any third party.
• Use the app for unlawful, fraudulent, or malicious purposes.
• Modify, alter, or create derivative works based on the app.
• Interfere with, disrupt, or attempt to gain unauthorized access to servers, networks, or systems connected to the app.
• Use automated means to access or collect information from the app.
• Use the app in any manner that violates applicable laws, rules, or regulations.

Termination

We may terminate your access to the app at any time and for any reason, including violation of this Agreement or our Privacy Policy. Upon termination, you must stop using the app and delete it from your mobile device.

Disclaimer of Warranties

The app is provided "as is" and "as available." We make no representations or warranties of any kind concerning the app or its content, including accuracy, reliability, completeness, or fitness for a particular purpose. Your use of the app is at your sole risk.

Limitation of Liability

In no event shall we, our officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, data, or other intangible losses arising from your use of the app.

Indemnification

You agree to indemnify, defend, and hold harmless Tumba Solutions Ltd., its officers, directors, employees, and agents from claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising from your access to or use of the app or your violation of this Agreement.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Bulgaria. Disputes arising from this Agreement shall first be addressed through good faith negotiations. If unresolved within thirty days, the dispute is subject to the exclusive jurisdiction of the Sofia City Court.

Changes to the Terms of Service

We may update or modify this Agreement from time to time. We will notify you of material changes by posting a notice in the app or sending an email to the address associated with your account. Continued use after changes are posted means you accept those changes.
